Sweepstake Participant Terms and Conditions

These are the Participant Terms and Conditions for the Anatomy of Emptiness NFT sweepstake (hereafter “Sweepstake”) offered by Tino Perdic located at F. Tudjmana 824A, K. Luksic, Croatia (hereafter “Artist”).

GENERAL CLAUSES

1. These Sweepstake Participant Terms and Conditions apply to the Sweepstake offered by the Artist and do not apply to any other services offered by and/or agreements with the Artist.
2. Participation in the Sweepstake implies the participant agrees with these Sweepstake Participant Terms and Conditions, as well as with all decisions the Artist takes to ensure the Sweepstake runs smoothly.
3. If any provision in these Sweepstake Participant Terms and Conditions is void or voided, the remaining provisions will remain in full force. The Artist will replace the void provision with new a provision, whereby the purpose and scope of the original provision will be taken into account as much as legally possible.
4. The Artist may at any time, in its sole discretion and without giving prior notice, change these Sweepstake Participant Terms and Conditions.

SWEEPSTAKE PARTICIPATION

5. The Sweepstake runs from the day all nine of the Anatomy of Emptiness NFTs have been sold at OpenSea marketplace
6. Participation in the Sweepstake is only open to persons holding at least one of the Anatomy of Emtiness NFTs and living in one of the countries in Europe, North America or South America
7. Participants will participate in the Sweepstake if they hold at least one of the Anatomy of Emtiness NFTs at the time the Sweepstake runs
8. Participants can increase their chances of winning the Sweepstake if at the time the Sweepstake runs they hold more than one of the Anatomy of Emptiness NFTs.
9. Participation in the Promotion is excluded for employees of the Artist as well as anyone who is (in)directly involved in any way in the development and the implementation of the Sweepstake.
10. Participants under the age of 18 are excluded from participation in the Sweepstake.

PRIZES AND RULES

11. Each participant in the Sweepstake has a chance to win one of the three prizes from a prize pool with a total worth of 2 ETH.
12. The Sweepstake begins seven days after the sale of the last (9th) item in the Anatomy of Emptiness Limited Edition of nine NFTs. Every Anatomy of Emptiness NFTs owner at the time the Sweepstake is to take place enters the Sweepstake (unless explicitly opting-out via email) where three winners will share a prize pool of 2 ETH.

    Each of the nine Anatomy of Emptiness NFTs counts for one entry in the Sweepstake. The maximum number of entries in the Sweepstake is 9, i.e. nine participants/owners. The minimum number of entries in the Sweepstake is 1, i.e. a single owner of all nine NFTs.

    The prizes for 3-9 participants are as follows:
    The first drawn winner will receive a prize of 1 ETH.
    The second and the third drawn will receive prizes of 0.5 ETH each.

    In case a single participant has ownership of more than one Anatomy of Emptiness NFTs he/she enters the Sweepstake with the corresponding number of entries as the number of Anatomy of Emptiness NFTs in possession, thus increasing the mathematical chances of being drawn. However, the same owner cannot be drawn more than once. In case of a single owner of all nine Anatomy of Emptiness NFTs the Sweepstake script will not be executed and the owner will automatically be considered as the first drawn and will receive the entire prize pool of 2 ETH. In case of the two owners of all nine Anatomy of Emptiness NFTs the script will choose only one winner who will be considered the first drawn and the other is automatically considered the second drawn. Both winners will share the entire prize pool of 2 ETH in the ratio of 60:40 for the first drawn, i.e. the first drawn will receive 1.2 ETH and the second drawn 0.8 ETH.

    A countdown until the draw of the winners is to take place will be displayed at https://tinoperdic.com/anatomy-of-emptiness-sweepstake seven days from the sale of the last item in the edition. The draw will be executed by a script once the countdown reaches the end (00d:00h:00m:00s) and the winners’ Anatomy of emptiness NFT owners will be listed as winners in the order they were drawn by the script.

    The prizes will be sent to winners’ wallets no later than 24 hours from the publication of the results. All winners will also be notified by email if they provided one.

13. Winners will be selected in an impartial and random manner by a computer script and will be notified by e-mail if they provided one no later than 24 hours after the Sweepstake has finished. There will be no other correspondence about the result. The results will also be published on the page https://tinoperdic.com/anatomy-of-emptiness-sweepstake no later than 24 hours after the Sweepstake has finished.
14. Exchanging prizes is not possible.

COSTS

15. To participate in the Sweepstake, no additional communication costs will be charged. Furthermore, no payment or purchase is required for participation in the Sweepstake.

RESPONSIBILITIES

16. The winner agrees to behave in accordance with any applicable rules of conduct of the Artist and/or other third parties concerned at any locations of the Artist and/or third parties.

RIGHTS OF THE ARTIST

17. The Artist reserves the right, without obligation of giving any reason and at its own discretion, to exclude participants from participation of the Sweepstake if the participant violates these Sweepstake Participant Terms and Conditions or any other legally applicable provision.
18. The Artist also reserves the right to prematurely terminate, interrupt or change the Sweepstake at its own discretion and without prior notice and/or modify the prizes that can be obtained if it cannot be reasonably expected from the Artist to adhere to the original terms, prizes and/or Sweepstake.
19. In the event of knowledge or suspicion of violations, fraud or abuse, the Artist has the right to suspend participation and/or to declare participation invalid, without obligation of giving any reason.

PRIVACY

20. Participants guarantee that that personal data provided during the participation procedure is correct, truthful, up-to-date and complete. The foregoing is required to be able to send any prize winners the prize, as well as sending the newsletter. The Artist can provide this information to third parties if this is necessary for the provision or the delivery of the prize.

INFORMATION, COMPLAINTS AND QUESTIONS

21. Any complaints or questions about the Sweepstake, prizes or these Sweepstake Participant Terms and Conditions may be sent directly to the Artist’s e-mail tperdic@gmail.com.
22. The Artist endeavours to respond to questions and complaints within 10 working days after receiving the complaint.
